Commission Terms of Service

By commissioning me, you are agreeing to the terms of service outlined below:

GENERAL DISCLAIMERS

  • All commissioned work will be delivered digitally

  • I reserve the right to refuse or discontinue a commission at any time (details in "Cancellation & Refunds" section)

  • The terms listed here may very slightly due to the type of commissioned work being created

  • My signature will be included on all deliverables

PAYMENT & FEES

  • Payment is due in full, upfront

  • Only USD is accepted at this time, payment will be requested via PayPal invoice after the commission is accepted

  • Additional fees will be charged for major revisions (outlined in "Revisions" section)

  • A rush fee of 50% will be applied to orders requested with a 48-hour turnaround

  • Clients will be informed of additional fees before they are applied to the established commission price

WHAT YOU RECEIVE

Final artwork deliverables are set to 300 DPI, RGB color mode JPEGs unless otherwise requested or specified.
You will receive the following, after client approval at the appropriate process stage(s):

  • Thumbnails (not available for all commission types)

  • Final sketch

  • Final artwork

The PSD file of your commission can also be purchased for an additional $5 (not available for all commission types).

PROCESS & SCHEDULE

  • A deadline will be agreed upon prior to starting the commission

  • Dimensions will vary depending on the type of commission, sizing can be customized upon Client request

  • A sketch will be sent to the Client for approval. Two rounds of revisions at this stage are included with the initial commission order

  • Sketch and subsequent work-in-progress images will be shared with Client when applicable, via their preferred communication method. These will be sent as low-resolution images

  • Client will be notified as soon as possible of any delays in completing the artwork. A minimum of one update will be provided per week

On principle, I will always make an effort to complete your commission within a timely manner.

REVISIONS

It is ultimately up to my descresion to determine what counts as a major vs minor revision. As a rule of thumb, major revisions request to change 50% or more of the artwork.

  • Two major revisions and multiple minor revisions during the sketch phase are included with the original commission price

  • A limited number of minor revisions are accepted during the coloring stage (does not apply to all commission types)

  • Revisions due to my own negligence/mistakes are free

  • Clients will be notified when they have reached the covered limit of revisions. Additional revisions will be invoiced separately

CLIENT OBLIGATIONS

  • Carefully read through my Terms of Service and Commission Information

  • Write in manner that is clear and concise when completing the Commission Order Form

  • Maintain professional conduct throughout the commission process, including responding in a timely fashion

  • Provide accurate reference material (mood boards and additional details are welcome!)

CANCELLATIONS & REFUNDS

  • The commission can be cancelled by the Client at any time, after which a refund will be issued equivalent to the work not yet completed

  • Refunds are not permitted once the final artwork is approved

  • You may not file a chargeback against me after approval has been given on the final artwork

  • I reserve the right to cancel the commission at any time, after which a full refund will be issued

  • Lack of timely communication on behalf of the Client will be recognized as implicit approval of all work progress and current state of the artwork

COPYRIGHT & USAGE

  • I, the artist, retain the rights over the created artwork. This includes the right to post the work on my social media and to stream, record, and/or upload videos of the process of creating the work (within reason)

  • Any characters portrayed in the work maintain their copyright to their respective owners

  • The artwork is for personal use only, unless commercial rights are purchased

  • The Client does not hold the right to use the work in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space

  • Commercial rights can be purchased for 300% the original commission price (this includes additional revision fees, if any)

  • The work may not be used to train AI models of any kind, or used in the space

  • Clear credit is required when utilizing the artwork in any form commercially

You may use the commissioned work for personal use in the following ways:

  • Print for personal use

  • Post the artwork on social media, with clear credit to the artist

  • Use the artwork as reference for study

  • Crop/resize the artwork for use across social media as a header, banner, video thumbnail, etc.

You MAY NOT use the commissioned work in the following ways:

  • Claim the work as yours

  • Paint over or alter the work in ways not listed above

  • Color in or alter sketches

  • Remove signature/watermark

  • Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI

  • Reproduce the work commercially without purchasing the rights from the artist (myself)
